Benakey SAS with a capital of €10,000 whose head office is located: 70 Chemin de l'Olivet, 06110 Le Cannet represented by Julie Sève in her capacity as President registered with the RCS of Cannes, 904 758 448.
These general conditions are applicable to all services ordered from the company present on the website www.benakey.com "Benakey" (hereinafter the <<Site>>), offering the following services: Rental Management, Concierge any act Annex. Decoration, communication, business provider, various intermediaries and other unregulated activities, all to meet the needs of our customer wishing to benefit from our services.
By continuing on our site, you therefore declare and acknowledge that you have read these terms and conditions and accept them without reservation. If we do not agree to the terms, you should no longer continue on this site.
Benakey reserves the right to modify its general conditions of sale at any time.
The website
The purpose of the site:
Travelers: is to introduce you to the properties as well as the destinations offered for seasonal rental, while benefiting from our concierge service.
Owners: Respond to requests from owners wishing to put their property up for seasonal rental.
Intellectual property
All content, photographs, texts, videos, sounds, comments, name, logo, remain the exclusive property of Benakey. All rights reserved.
You may use the data from the site only for your personal use, however it is prohibited to use our data for commercial use.

Check-in / Check-out
We make every effort to ensure that your accommodation is available as soon as possible and no later than 5:00 p.m. On the day of departure, the accommodation must be vacated by 10 a.m. at the latest, unless agreed by Benakey. Any early or late departure or arrival is likely to incur additional costs, unless otherwise agreed by Benakey.
Security deposit
We ask for a security deposit which varies according to the type and the services of the accommodation, it will be "pre-registered" and "not cashed" automatically on your credit card as a security deposit. This sum will be released, except in the event of any damage caused. It can be used if necessary for the payment of extra concierge services.
Inventory
On your arrival, an inventory is made available to you in the accommodation. This will need to be checked. In the event of a dispute on your part, please notify us immediately by email to contact@benakey.com. In the absence of any disputes, the inventory will be deemed to be compliant and accepted without reservation.
Reservations and payment
Benakey offers properties for short-term rental on its site and partner sites. A 20% deposit is requested at the time of booking, the balance will be requested 30 days before arrival.
Smoking
It is strictly forbidden to smoke inside the accommodation or in the common areas. If the accommodation is composed of an outdoor space, you will find an ashtray.
Laundry
All household linen is provided: Sheets and towels.
Housework
A cleaning will be carried out before the arrival of the tenants and after their departure. If the tenant wishes to benefit from a cleaning during his stay, he must notify the Benakey agency in writing. We ask at the time of departure, that the dishwasher be empty, dishes clean and tidy, bins emptied. If the accommodation is dirty beyond normal use, an amount of €100 for may then be deducted from the amount of the security deposit. The traveler authorizes the cleaning team to pass with or without his presence in the accommodation, if he wishes an additional cleaning.
Wifi
All our accommodations, except Benakey's notice, have internet access, the price of which is included in the rental. Benakey cannot be held responsible for any temporary interruption of the Internet service due to the access provider or any other cause beyond its control. No refund or commercial discount will be made in the event of unavailability of network access.
Air conditioning and heating
Benakey cannot be held responsible for any malfunction of the air conditioning or heating for any cause beyond its control. No refunds or trade discounts will be made.
Cancellation clause
The furnished real estate designated below is exclusively subject to seasonal rental, as a temporary residence and pleasure of the lessee. As such, this rental is excluded from the scope of the french law n ° 89-462 of July 6, 1989.
Responsibility
All accommodations have been checked and reviewed by Benakey. The descriptions given are in accordance with reality and were written in good faith. In the event of a complaint, the traveler undertakes to notify them within 24 hours by e-mail. The customer agrees to work with Benakey to try to resolve the problem. In the absence of written communication and explicit authorization from Benakey, the client who abandons his accommodation before the agreed date, will lose the right to a possible refund of the rental amount.
Any complaints notified after the end of the stay will not give rise to any refund. Benakey reserves the right to terminate the contract before or during its execution if unforeseeable circumstances or a case of force majeure would make the enjoyment of the apartment impossible. Benakey reserves the right to assign another accommodation with similar or superior characteristics if available. If the customer refuses the transfer of the reservation, Benakey will reimburse the full amount paid for the reservation, in this case no compensation will be granted.
Default of payment
In the absence of payment on the due dates or in the event of non-performance of one of the clauses of this commitment and five working days after a simple summons by registered letter which has remained unsuccessful, this contract will be immediately terminated and the lessor may avail himself of the article 1590 of the French civil code to keep the deposit paid as first damages.
In the event of non-payment of the balance, the agency reserves the right to refuse the entry of the guest into the accommodation.
Intervention and repair
If during the stay the owner must involve companies at the lessee's request (request must be made by email) to restore damaged equipment (clogged pipes, damaged household appliances, broken glass, etc.) these interventions will be invoiced.
In the event of non-return of the keys (or loss of keys), a change of lock will be carried out at the expense of the traveler, for security reasons.
Concierge Service
Benakey offers concierge services, which as optional services and payable by the customers. These services must be paid for before arrival, during the stay or afterwards as needed. All concierge services must be paid in full.

Responsibility for concierge services and service providers
Benakey undertakes to carry out, as far as possible, all requests that the client asks of it and to satisfy them within the limits provided for by the rules of ethics. Benakey disclaims all liability caused by external service providers or activities that may result in delay, incapacity or death (transport: car, planes, helicopter, private jet or activities (parasailing, jet ski, etc.)
Minimum booking days
For any reservation, Benakey reserves the right to impose a minimum number of days of occupation depending on the season concerned, and during the end of year holidays.
Pets
Pets are accepted in some of our properties. Benakey may have the right to refuse pets and reserves the right to charge the hirer for any damage the pet may cause.
Damage
The customer is responsible for any direct or indirect damage that he or his participants may cause during the rental.
Owner's obligation
The owners and customer acknowledge and accept that the Company does not intervene under this Contract as an insurer and that it is therefore their responsibility to take out an appropriate insurance contract for the accommodation and its contents.
Language
These general conditions of sale are written in English and French.. In case of contradiction, only the French version will prevail between the parties.
CANCELLATION POLICY
In case of cancellation less than 30 days before arrival, Benakey reserves the right to keep 50% of the total amount paid by the client. In case of cancellation less than 7 days before arrival, Benakey reserves the right to keep 100% of the total amount paid by the client, in case of no show on the scheduled date of arrival, the full balance will be claimed by Benakey, who then reserves the right to dispose of the accommodation immediately. If the guest decides to leave before the scheduled date, the unused nights are not refunded and Benakey reserves the right to take possession of the property upon departure.
Benakey reserves the right to cancel any booking reservation if one of the following elements has not been received prior the day of entry to the accommodation:
- The total payment of the property the guest has requested to rent
- The deposit
- The supporting documents that Benakey will be entitled to ask you for, example: certificate of civil liability and the client’s ID.
COVID-19 CANCELLATION POLICY:
Exceptionally, in case of cancellation due to COVID-19, customers can benefit from our "exceptional covid-19 policy". In order to be eligible for this cancellation policy, customers will be required to provide proof of their inability to travel, below are the evidence exemple Benakey may ask you:
- Travel agency cancellation email for cancelled flight due to COVID-19.
- The lockdown period is reactivated by government decision.
- If the customer cannot go to the rented property by government decision, by default if his personal address is more than a certain km that the government will announce. Only the personal address of the "customer" who signs the lease will be taken into account
The customer cannot claim any compensation other than the reimbursement of the deposits and the balance if the Agency is unable to rent the accommodation.
COOKIES
Browsing the www.benakey.com site is likely to lead to the installation of cookie(s) on the user's computer. Cookies are small files, which are generally stored on a server (telephone, computer, tablet, etc.), recording the user's browsing information but do not allow the user to be identified. However, if the user refuses the installation of a cookie, the latter may make it impossible to access certain services.
